It is necessary to read these General Terms and Conditions of Contracting prior to the acceptance of the same by the Client.
These General Terms and Conditions of Contracting (hereinafter, "GTC") will govern the relationship between the client (hereinafter, the "Client") and Sarton Dominicana, S.A.S. h/n/c IKEA Puerto Rico (hereinafter, the "Company"), an entity authorized to do business in Puerto Rico and organized under the laws of the Dominican Republic, whose postal address is PMB #106, PO BOX 8700, Carolina, PR 00988-8700, in relation to the loyalty program "IKEA FAMILY-Club de Ventajas" (hereinafter, the "Program").
The Company directs the Program, through which the Client receives rewards for their purchases. The Program increases communication between the Client and the Company. In addition, the Client obtains the following benefits: a free membership card, discounts in their IKEA store located in Puerto Rico, access to the Club de Ventajas online, discounts, special offers, birthday gifts, as well as other benefits mentioned below.
IKEA FAMILY Membership Card - Club de Ventajas: The IKEA FAMILY Card (hereinafter, the "Card"), can be obtained through the website www.IKEA.pr (hereinafter, the "Website"), or in their IKEA store located in Puerto Rico and is aimed at people over 21 years old. To participate in the Program, the Client must complete the corresponding application. With this, the Client will provide the requested personal data, which must be updated if any changes occur. Since their benefits are linked to the contact phone information, failure to notify changes in it may imply a loss of obtained benefits. The Client must provide all required information to be part of the Program. The Card grants the Client the following benefits, which may be enjoyed in accordance with the rules indicated here:
Gift Checks: The Client will accumulate five percent (5%) of the value of their purchases, similarly it will be deducted in case of returns, amount that will be received through gift checks redeemable in subsequent purchases made in their IKEA store located in Puerto Rico. Gift checks will not be valid in IKEA stores located outside Puerto Rico. Checks will be issued when the Client has accumulated a minimum of eight dollars ($8.00), up to a maximum of two hundred dollars ($200.00) monthly. Any excess in purchases above the previously indicated amount will not be taken into consideration. Pending balances of discounts not paid to the Client current as of this date will expire at 24 months accumulated, regardless of the reason. Balances accumulated in or before the 24 months prior to this date cannot be claimed by the Client, as they have expired. Each gift check will be issued thirty-five (35) days after the end of the month in which the Client made their purchases in their IKEA store located in Puerto Rico. The issuance of gift checks will be generated within the first five (5) days of each month. Gift checks will be consumable in their entirety. They can only be redeemed by the Client, not transferable to any other person or entity different from the Client. Each gift check will have a validity of ninety (90) days, counted from the date of issuance of the same, it is necessary to consume the amount in its entirety on the same day of its use. For purchases made and paid with gift checks, the return and warranty policy established by the Company applies. The Client can view their accumulated discounts by logging into www.IKEA.pr, where they can also update their data and print a provisional card, while receiving the official Program Card. To claim their gift checks, the Client must provide the required information. Otherwise, they will not have the right to claim the accumulated amounts. The Client can download their gift check from the Website www.IKEA.pr, or can request it by phone at the customer service number 787-750-4532.
Offers: The Client will receive information about offers on furniture and decoration from the Company before they are communicated to the general public. Which will allow them to be the first to enjoy them.
Special Offers: The Client will have access to special offers in their IKEA stores located in Puerto Rico. The Client will receive offers and information about current activities through the email provided by them, or via SMS, according to their preference. If the Client does not wish to receive information about offers, they must indicate it in the options sent in the emails or text messages.
Birthday Gift: We are looking forward to your birthday! The Client who has a birthday will accumulate ten percent (10%) of the value of their purchases on their birthday, two days before and two days after. These amounts will accumulate in the same way as exposed above in the "Gift Checks" section.
Information about new products: Members of this Program are the first to receive our catalogs with the new products arriving at their IKEA store located in Puerto Rico.
Return of merchandise: The Client has an extended period of one hundred twenty (120) days for changes and returns of merchandise acquired by them. For more information about the Company's return policy, you can enter the Website. Once the merchandise is returned, the points accumulated in the Client's IKEA FAMILY Program Card that have been accumulated based on said purchase will be adjusted.
The Card will be used before processing the payment by presenting it physically to the cashier. The Client must present their identification when using their Card.
Communications between the Client and the Company: The Client will identify themselves, in all their communications with the Company, by means of the last eight digits of their Card, likewise, the Company for the purposes of guaranteeing the legitimacy of the holder may request additional information, which will be for the exclusive use of the Company, subject to the Company's Privacy Policy. Any notification by the Company to the Client will be directed to the email address provided by the Client. For any doubt related to the Program, the Client can communicate from Monday to Saturday within the hours of 9:00 A.M. to 9:00 P.M. and Sundays from 11:00 A.M. to 7:00 P.M., to the following customer service number 787-750-4532, through our email atencion@ikea.pr.
Client Obligations: The Client is obligated to comply with these GTC. The issuance and use of the Card authorizes the Company to use the Client's data for advertising or promotional purposes exclusively, without any compensation for it. The holder of the IKEA Family loyalty card is obligated to notify any change in their contact information. Since their benefits are linked to the telephone contact information, failure to notify changes in it may imply a loss of obtained benefits. If not in agreement, the Client must express their refusal to use their personal data for the aforementioned purposes, contacting the points indicated in the previous section "Communications between the Client and the Company". However, the Client who requests not to receive advertising from IKEA or Companies associated with the Program also waives receiving the discounts and benefits derived from said Program.
The Client accepts receiving periodic information from the Program and expressly authorizes the Company to collect and process their personal data for the purpose of developing the Program, including marketing actions (postal mail, email, magazine, SMS, statements, raffles, etc.) of the Program and associated Companies, as well as to process them and transfer them to third parties (Companies associated with the Program and occasionally to other companies interested in communicating an offer to the Client) for other marketing purposes.
The Client agrees to defend, indemnify, hold harmless and protect the Company from any claim, damage, judgment, penalty, cost and expense (including those expenses and attorney's fees resulting from the Company exercising its rights under this clause) that arises, directly or indirectly, from the Client's activities, under any law or regulation, regardless of whether such claims were filed by any other person, natural or legal. The Client's obligations under this indemnification clause will survive the termination of these GTC.
The Client may not assign their rights and obligations under these GTC. However, the Company may assign its rights and obligations under these GTC, in whole or in part, without the Client's consent and all terms and provisions of the same will benefit its successors and assignees in the same way. These GTC may not be altered or amended unless through another document or written agreement granted by both parties.
Company Obligations: Any obligation incurred by the Company, derived from any damage caused to the Client under this GTC and that constitutes a legally enforceable obligation, will be assumed by the Company up to the maximum limit of $100.00.
Modifications, Resolution and Contractual Cancellation: The duration of this contract is indefinite, being able to be canceled at any time in accordance with the conditions established below.
Both parties may terminate this agreement at any time, with full indemnity and without the need to allege just cause, thus ending participation in the Program by written notification to the other party with at least one (1) month in advance of the planned termination date and by the means indicated previously. In the event that the Company unilaterally cancels the program, this fact will be made public on the Website and will be notified simultaneously to the Client via email.
If the Client has used their Card and then decides to cancel it, the Company will return the accumulated amount in a gift check if it reaches the minimum of eight dollars ($8.00), up to a maximum of two hundred dollars ($200.00), in accordance with the rules explained in the "IKEA FAMILY Membership Card - Club de Ventajas" section.
The Company reserves the right to introduce, at any time, changes to these GTC, to the discount tables or to any other rule related to the development of the Program, safeguarding the rights acquired by the Client up to that moment. The modifications made will enter into force automatically and will be understood as accepted by the Client from their publication on the Website.
The client must keep their data updated, a situation that constitutes an indispensable requirement for the validity of this agreement, otherwise, the Company reserves the right to end participation in the program. In cases where the Client makes improper use of the Program, breaches these GTC, or it is impossible to continue providing the services described here, the Company reserves the right to terminate this agreement with the Client by notification to the electronic address provided by them.
Privacy Policy and Handling of Client Information: The security of your personal information is a priority for us. Our commitment to our customers and users extends to the way we handle your personal information. As explained below, we only collect the information we need to continuously improve your shopping experience in your IKEA store located in Puerto Rico. Privacy Policy. No personal information of the Client or user will be collected unless such information is provided voluntarily. We maintain a database with all the personal information provided by our customers at the time of their registration.
Collected Information. As part of our marketing efforts aimed at improving service and the needs of our clientele, we maintain a database with information of each Client, which may include data such as: name and surnames; date and/or place of birth; marital status; gender; physical or postal address; email address; telephone numbers; driver's license number, data related to their business, home; and digits of their social security. Likewise, occasionally the Company may request additional data, for the purpose of developing the Program, implementing marketing actions, such as offers, campaigns exclusively oriented to attend to the purposes of the Program to which it belongs. The client or user may exercise their rights of access, rectification, cancellation or opposition to the processing of their data by sending a request in this regard to SARTON DOMINICANA, SAS PMB#106 PO Box 8700 Carolina, PR 00988-8700.
Automatically Collected Information. When requesting services through the Website, or any related page or portal (hereinafter, "the Portal"), the Client is asked for certain personal information for the sole purpose of being able to provide the requested services and 2/3 verify the Client's identity. In addition, the Portal's server automatically collects certain non-identifiable information about Portal users. Specifically, each time a hypertext transfer protocol request (http request) is received, information will be collected and stored in files about the date and time of the request, the Internet protocol address from which the request originates and the purpose of the same.
Why is personal information of Clients collected? Personal information about Clients and users will only be stored if they decide to provide it freely and voluntarily. The personal information that the user voluntarily provides when accessing the Portal, the services or through our points of sale, will be used for the purpose of providing the requested services, verifying the identity of the Client/user and ensuring the security and reliability of the transaction. The personal information collected will help us better serve the needs of customers/users in the search for products offered by our company as well as to keep them informed about special sales and new merchandise.
How is the personal information of customers/users used? The Client/user information, collected on or through the Portal or from our points of sale, will not be sold or transferred to third parties, except as set forth here. The personal information that the user provides on this Portal will be used solely for the administration and management of the services offered therein and for other purposes described in this statement or on the site where the information is requested. Information of a generic type may also be collected for statistical purposes and for the maintenance and improvement of the Portal. For this purpose, such information will be analyzed from time to time, to determine the interests of customers/users and the frequency with which our customers visit the Portal. The information collected for these purposes on the Portal is in a format that does not allow personal identification of the user.
With whom is the personal information of Clients / users shared? The personal information of users may be shared with entities affiliated with the Company and certain other entities, identified on the Portal (the Company, its affiliates, and the other companies identified on the Portal, jointly, hereinafter, the "Entities"), for the purpose of disseminating information about special sales, information on new products and / or services, etc. On such occasions, only the information necessary to carry out said transaction will be disclosed.
Access to collected personal information. Each Client/user will have access to their information that has been collected on or through the Portal. The Portal administration undertakes to correct any error related to the personal information that the Client/user notifies to the following address SARTON DOMINICANA, SAS (IKEA) PMB#106 PO Box 8700 Carolina, PR 00988-8700.
Protection of collected information. The Company will not transfer the data of its customers to any third party outside the Entities, its affiliates and certain other entities, without prior written consent of the affected customers. The information of users collected and stored will be protected and the Internet will not be used to provide services unless it can be done in a secure manner. To this end, reasonable precautions will be taken to maintain the security, confidentiality and integrity of the collected information. Notwithstanding the provisions in these GTC, occasionally third parties will be contracted to provide certain services with respect to their database, to whom the due demands will be made so that the security, confidentiality and integrity of the personal information to which said contractors may have access during the course of performing their services is not compromised.
Information of persons under 21 years old. Information of contact of persons under 21 years of age will not be collected nor will the Membership Card be issued to them.
Warning regarding the use of email. Email is not a secure means for the transmission of personal information of the Client/user. Therefore, the Client/user is warned not to send personal information through email.
Acknowledgment of the Client / user. The Client/user acknowledges and accepts that their registration data may be used by the Entities, for sporadic advertising communications exclusively of the same and that their data have been or will be incorporated into the distribution list to which the same may send their commercial communications. At any time, the Client/user may request their immediate exclusion from said distribution list, in order to no longer receive information from the Entities. The Client/user guarantees and responds, in any case, for the truthfulness, accuracy, validity and authenticity of the personal data provided.
These GTC and any other related document, will be governed and interpreted in accordance with the laws of the Commonwealth of Puerto Rico. The Client agrees to submit to the jurisdiction of the state courts of Puerto Rico.
Applicable Law; Jurisdiction: The Client accepts and acknowledges that the Card of the "IKEA FAMILY-Club de Ventajas" loyalty program has no cost for the Client, as well as that it is not a "Gift Card" as defined in the Regulation on Gift Cards, Regulation Number 8704 of the Department of Consumer Affairs, so the provisions of this are not applicable to it.
Headings: The headings of the sections and clauses in this document are included for reference and convenience and will not constitute any part of the same. The words used herein will be interpreted in the gender or number that the circumstances require.
Validity: If any clause of these GTC results invalid, illegal or could not be enforced in Puerto Rico, the validity and effectiveness of the other clauses and conditions will not be affected thereby, nor will the validity and effectiveness of said clause and the other clauses in any other jurisdiction where the clause is considered valid be affected.
Acceptance of these GTC: By accepting the Card and its use, the Client declares to recognize these conditions, accepting them freely and voluntarily, giving their conformity to all the terms.
By accepting these GTC, the Client accepts receiving periodic information from the Program.
